1. Eligibility

You must be at least 18 years of age to use AceTheTest. By using the service you confirm that you are 18 or older. If you are under 18, you are not permitted to use this service.

By registering, you confirm that the information you provide is accurate and that you are legally capable of entering into a binding agreement.

2. Description of Service

AceTheTest is an AI-powered training plan generator that creates personalised running training schedules for fitness test candidates. Plans are generated based on information you provide, using coaching methodology developed by Dominique de Rooij (Level 2 accredited running coach).

3. Account Registration

• You must provide a valid email address and create a secure password to use the service
• You are responsible for maintaining the confidentiality of your account credentials
• You must not share your account with others
• You must notify us immediately if you believe your account has been compromised
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Payments and Pricing

AceTheTest offers the following plans, each as a one-off payment:

All payments are processed securely by Stripe. By making a purchase you agree to Stripe's terms of service. We do not store your payment card details.

4.3 Access period

Your access period begins on the date of purchase. Plans are not automatically renewed. You will receive a notification before your access period expires with the option to renew.

4.4 Pricing changes

We reserve the right to change our pricing at any time. Price changes will not affect purchases already made.

5. Refund Policy

Refunds will be processed to the original payment method within 5–10 business days.

6. Acceptable Use

You agree not to use AceTheTest to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to our systems or another user's account
• Use automated tools to scrape, copy, or extract content from the service
• Resell or redistribute training plans generated by the service without our written permission
• Provide false information when generating a plan
• Use the service if you are under 18 years of age

7. Intellectual Property

All content on acethetest.app — including but not limited to the coaching methodology, system prompts, website design, and branding — is the intellectual property of AceTheTest and Dominique de Rooij.

Training plans generated for you are for your personal use only. You may not reproduce, distribute, or commercialise them without our written permission.

8. Disclaimer of Warranties

AceTheTest provides the service on an "as is" and "as available" basis. We make no warranties, express or implied, that:

• The service will be uninterrupted, error-free, or completely secure
• The training plans generated will achieve specific fitness outcomes or test results
• The service will meet your specific requirements

Individual results from following a training plan will vary depending on your starting fitness, consistency of training, and other factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, AceTheTest and Dominique de Rooij shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to:

• Personal injury or illness arising from following a training plan
• Failure to pass a fitness test
• Loss of data
• Any other loss or damage

Our total liability to you for any claim arising from your use of the service shall not exceed the amount you paid for your current access period.

10. Medical Disclaimer

Exercise carries inherent risks. By using AceTheTest you acknowledge that:

• You are voluntarily participating in a physical training programme
• You have consulted or will consult a qualified medical professional before beginning the programme, particularly if you have any health conditions, are pregnant, or have been previously injured
• AceTheTest is not a medical service and does not provide medical advice
• You assume full responsibility for any injury, illness, or health consequence arising from following a training plan generated by this service

11. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms. If we terminate your account without cause, we will issue a pro-rata refund for any unused access period.

You may close your account at any time by contacting us at Contact form. Account closure does not entitle you to a refund unless you are within the 14-day satisfaction guarantee period.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the site. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Nothing in these Terms affects any non-excludable rights you may have under Australian Consumer Law or other applicable consumer protection legislation.
